The NBA legend Testifies He Felt No Fear of Nascar in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Financial Stakes and a Will to Win

Jordan shared operational insights of his racing venture, revealing he invested $40m of his own funds into the Cup Series operation co-founded with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Renewal Demands

The heart of the case involves the end of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for an hour and left the court to a media frenzy, with onlookers and reporters vying for a view or a picture of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with another racing team for Nascar to overhaul a operating model Jordan contended is breaking the law to keep two hands on the wheel.

Heather Gibbs’ Testimony

Heather Gibbs detailed her push for indefinite franchises, which she said a written letter to Nascar. She testified the pressure of the signature deadline was problematic.

She said, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
