US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face alien smuggling charges, he was held in federal custody.

In her decision, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court proceedings involve disputed claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.

The court, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
